Contractual terms for publications on ZMO institutional repository
1. Online Provision
Leibniz-Zentrum Moderner Orient (ZMO) is granted the non-exclusive (simple) right to freely publish electronically on the Internet and to archive in ZMO institutional repository (IR). As part of the simple usage, ZMO is allowed to offer a cost-covering printing-on-demand option, provided that this does not conflict with the exploitation rights of third parties to the author's work. All other rights for the exploitation of the work remain with the author. Registration does not create a legally binding claim to online provision of a document. As part of the public provision, users are entitled to download, save or print documents in small quantities for private and other personal use § 53 UrhG [1]. The author can grant additional rights by adding a Creative Commons license [2].
2. Third Party Rights
The publisher declares that no third-party rights are infringed by the publication of the document and any of its components, such as cumulative dissertation papers. The publisher releases ZMO from any claims by third parties. ZMO is entitled to block access to a publication if there are specific indications of a violation of third-party rights. The operator will inform the publisher in such a case of the blocking.
3. Archiving and Transformation into Other Formats
ZMO has the right to store the document in an archive and, if necessary (e.g., migration, accessibility, better accessibility, indexing), to convert it into other electronic and physical formats and to exploit them in accordance with No.1
4. Transfer to the German National Library
ZMO is allowed to provide the electronic version to the German National Library (DNB) via the library as part of the mandatory deposit under the German National Library Act.
5. Dissertations, Habilitations, and Qualification Papers
If the document is a qualification paper (dissertation, habilitation, master's, bachelor's, diploma thesis, etc.), the publisher assures that the files delivered correspond to the version approved by the department and that the responsible institution has agreed to the publication of the document. If a CV is part of a qualification paper, the publisher agrees that it will be stored electronically and made publicly available.
6. Withdrawal of Consent
Withdrawal of this consent is only possible with reference to § 42 UrhG (work no longer corresponds to the author's conviction). The operator is entitled to charge the publisher for the additional expense incurred as a result.
